1. Acceptance of Terms

By accessing or using My Clock Academy (the "App"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you (the user or parent/guardian) and The MobiLab ("we", "us", "our"), the developer of My Clock Academy.

2. Age Requirements and Parental Consent

Target Audience

My Clock Academy is designed for children aged 4-9 years old. The App is intended to be used by children under the supervision of a parent or guardian.

Parental Consent

If you are under 18 years old, you must have your parent or guardian's permission to use this App. By using the App, you represent that:

• You are at least 4 years old, OR
• You have obtained consent from your parent or guardian to use the App

Parent/Guardian Responsibility

Parents and guardians are responsible for:

• Monitoring their child's use of the App
• Managing In-App Purchases through device settings
• Ensuring appropriate use of the App
• Understanding and agreeing to these Terms on behalf of their child

3. License to Use

Grant of License

Subject to your compliance with these Terms, The MobiLab grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on iOS devices you own or control
• Use the App for personal, non-commercial, educational purposes

Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or redistribute the App
• Remove any copyright or proprietary notices from the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the App

4. App Features and Content

Educational Content

My Clock Academy provides educational content designed to teach children how to tell time. The App includes:

• Three game modes: Practice, Challenge, and Word Problems
• Five difficulty levels from beginner to expert
• Interactive analog and digital clock displays
• Progress tracking and achievement system
• Voice narration for questions (optional)

Content Accuracy

While we strive for accuracy in our educational content, we make no warranties about the completeness or accuracy of the information provided. The App is a supplementary learning tool and should not be the sole source of education on telling time.

5. In-App Purchases

Space Cadet Pass

My Clock Academy offers a "Space Cadet Pass" In-App Purchase that:

• Is a one-time, non-consumable purchase
• Unlocks all game modes (Challenge Mode, Word Problems)
• Unlocks all difficulty levels (Medium, Hard, Expert)
• Enables voice narration and achievements
• Is processed through the Apple App Store

Pricing and Payment

• All prices are displayed in your local currency
• Payment is charged to your Apple ID account
• Prices are subject to change without notice
• No refunds except as required by law or Apple's policies

Parental Controls

Parents can disable In-App Purchases through iOS Settings → Screen Time → Content & Privacy Restrictions.

6. No Advertisements

My Clock Academy does not contain any advertisements. The app is completely ad-free and does not use any advertising SDKs or ad networks.

7. User Conduct

You agree to use the App appropriately and lawfully. You must NOT:

• Use the App in any way that violates applicable laws or regulations
• Attempt to interfere with the App's functionality or security
• Use automated systems to access the App
• Transmit any viruses, malware, or harmful code
• Collect information about other users

8. Intellectual Property Rights

Ownership

My Clock Academy and all its content, features, and functionality are owned by The MobiLab and are protected by:

• Copyright laws
• Trademark laws
• International intellectual property laws

Trademarks

"My Clock Academy" and associated logos are trademarks of The MobiLab. You may not use these marks without our prior written permission.

User-Generated Content

Since the App does not collect or transmit user data, there is no user-generated content to license back to us.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. App Updates and Modifications

We may release updates to improve the App, including:

• Modify or discontinue the App (or any part of it) at any time
• Change features, functionality, or content
• Update pricing for In-App Purchases

11. Disclaimers and Warranties

No Warranties

To the fullest extent permitted by law, we disclaim all warranties, including:

• Merchantability: The App is suitable for its intended purpose
• Fitness for Purpose: The App meets your specific needs
• Non-Infringement: The App doesn't violate third-party rights
• Accuracy: Content is completely accurate or error-free
• Availability: The App is always available or uninterrupted

Educational Supplement

My Clock Academy is designed as a supplementary educational tool. We make no guarantee that use of the App will result in any particular educational outcome or skill level.

12. Limitation of Liability

Damages

To the maximum extent permitted by law, The MobiLab shall NOT be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or data
• Loss of use or inability to use the App
• Damages arising from your use or inability to use the App
• Any unauthorized access to or alteration of your data

Maximum Liability

In no event shall our total liability to you exceed the amount you paid for the App or In-App Purchases in the 12 months prior to the claim, or $100 USD, whichever is greater.

Applicable Law

Some jurisdictions do not allow limitations on warranties or liability, so the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless The MobiLab and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Any content you submit or transmit through the App

14. Apple App Store Terms

Acknowledgment

These Terms are between you and The MobiLab only, not Apple Inc. Apple is not responsible for the App or its content.

Scope of License

The license granted to you is limited to a non-transferable license to use the App on an Apple-branded product running iOS that you own or control, as permitted by the App Store Terms of Service.

Maintenance and Support

The MobiLab is solely responsible for providing maintenance and support for the App, not Apple.

Warranty

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.

Product Claims

The MobiLab, not Apple, is responsible for addressing any claims relating to the App or your use of it, including:

• Product liability claims
• Claims that the App fails to conform to any legal or regulatory requirement
• Claims arising under consumer protection law

Intellectual Property Claims

The MobiLab will be responsible for investigating and defending any claim that the App infringes a third party's intellectual property rights.

Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you.

15. Termination

By You

You may stop using the App at any time by deleting it from your device.

By Us

We may terminate or suspend your access to the App immediately, without notice, if:

• You breach these Terms
• We are required to do so by law
• We decide to discontinue the App

Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• You must delete the App from all devices
• Provisions that should survive termination will continue (e.g., disclaimers, limitations of liability)

16. Governing Law and Jurisdiction

Applicable Law

These Terms shall be governed by and construed in accordance with the laws of Greece, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or use of the App shall be resolved through:

1. Good faith negotiations between the parties
2. Mediation if negotiations fail
3. Binding arbitration or court proceedings in Greece if mediation is unsuccessful

Exceptions

Nothing in these Terms affects your statutory rights as a consumer under applicable law.

17. Changes to Terms

Right to Modify

We reserve the right to modify these Terms at any time. We will notify you of changes by:

• Updating the "Last Updated" date at the top of this page
• Posting a notice in the App
• Updating the App Store listing

Acceptance of Changes

Your continued use of the App after changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The MobiLab regarding the use of the App and supersede all prior agreements.

21. Language

These Terms are provided in English. Any translations are provided for convenience only. In case of conflict, the English version shall prevail.
